We would need the following documents in order to complete the filing procedures:

Power of attorney

The Power of attorney should be singed before a Notary Public and legalized with the Hague Apostille.

Priority Document/s (if claiming priority under the Paris Convention)

A certified copy of the foreign application (only certified by the Patent Office of the country of origin).

Kindly note that according to Circular Letter No. 11 of the Argentine Patent Office, the Spanish translation of the priority document should be certified by an Argentine Public Translator.

If the specification and claims of the priority document are not the same as the text to be filed in Argentina, a comparing translation must be effected in order to provide the Argentine Patent Office with an accurate translation of said document. Our charge for comparing and certifying the Spanish translation of the priority document is U$S 6,50.- per 100 words.

Moreover, if the text of the priority document is the same than the specification filed in our country, an Argentine Public Translator should certify the Spanish translation attached to the priority document. Our charge for certifying said translation is U$S 5.- per page.

One of the alternatives below should be chosen to assign priority rights when the Argentine applicant is different from the applicant of the priority application.

Copy of the Assignment Document filed with the foreign Patent Office:

If you send us a copy of the Assignment Document filed before the foreign Patent Office, the same should be notarized and legalized with Apostille, or, in any event, legalized by the nearest Argentine Consulate.

Bilingual Assignment Document form provided by our Firm:

NO LEGALIZATION REQUIRED when this document contains the original signatures.

OR

Bilingual Sworn Declaration of Inventors document form provided by our Firm:

NO LEGALIZATION REQUIRED when this document contains the original signatures.

Moreover, please note that if the assignment is signed after the filing date of the Argentine application, the document should have a retroactivity clause as in the document forms attached herewith.

Please bear in mind that the term for filing the priority document and the assignment document/sworn declaration of inventors falls due after 90 days as from the Argentine application filing date and such date is unextendable.
