Estate planning in Argentina for foreign owners

Why Plan Your Estate in Argentina Now
If you own an apartment, land, a business or bank accounts in Argentina but live in the U.S., Canada or Europe, two legal systems may apply to what you leave behind. Argentina has forced heirship rules: part of your estate is reserved for your children, spouse or parents. Without a plan, your family may face a long probate case, extra costs and disagreements that could have been avoided.
Plan Your Estate Without Traveling
You don’t need to get on a plane. We review your family, your assets and your goals by video call, you sign your will where you live, and any transfer in Argentina can be signed through a power of attorney. Our estate planning lawyers take care of the rest, anywhere in Argentina. Estate planning is one of the services our estate lawyers in Argentina handle for foreign families.
Clear Options, Costs and Timelines in English
No surprises. We explain in plain English what Argentine law allows, which options fit your family and what each one costs before we start. Then we prepare the documents and keep you posted until everything is signed and registered.
Wills, Donations and Property Titles in Argentina
A will is only one tool. Depending on your goals, we can review how your property is titled, plan a donation while you keep the right to live in or rent the property (usufruct), or make sure your Argentine plan works with the will or trust you already have back home.
One Point of Contact for Legal, Tax and Notarial Matters
We are a one-stop legal solution. Our team includes lawyers, accountants, Argentine notaries (escribanos) and certified translators, all under one roof and coordinated by attorney Elias Kier Joffe. When needed, we also work directly with your own lawyers and accountants back home, for example to check the tax impact of your plan in your country.
Our estate planning services include:
✓ Estate planning for foreigners with property in Argentina.
✓ Wills that work in Argentina, signed here or abroad.
✓ Review of wills and estate plans signed in another country.
✓ Forced heirship analysis: what you can freely leave, and to whom.
✓ Donations of property with a reserved usufruct.
✓ Review and restructuring of how your property is titled.
✓ Plans that protect a surviving spouse and children.
✓ Our own lawyers, accountants, notaries and certified translators, working with your advisors back home when needed.

Who you’ll work with
Meet Your Argentine Estate Planning Lawyer, Elias Kier Joffe
Hi, I’m Elias Kier Joffe. My grandfather founded this firm in Buenos Aires in 1940, and I’m the third generation leading it.
I know planning ahead isn’t easy. Nobody likes to think about what happens after they’re gone, and doing it in another country, in another language, is even harder. My job is to make it simple.
I oversee every case personally, and I’ll always tell you the truth about your case, even when it’s not what you want to hear.
You’ll always know who’s looking after your family’s plan: me.
FAQ
Frequently asked questions
Do I need to travel to Argentina?
No. We work by video call, phone and WhatsApp. You can sign your will where you live, following that country’s formal requirements, and any transfer of property in Argentina can be signed through a power of attorney. Some clients like to fly in for the signing, but it’s never required.
How much does estate planning cost in Argentina?
Honest answer: it depends on your case. Here’s what moves the price:
• How many assets you have in Argentina, and in which provinces.
• What you need: only a will, or also donations or changes to how your property is titled.
• Whether you already have a will or trust abroad that the Argentine plan has to work with.
• How many family members are involved.
Simplest case: one apartment and a simple will. Most complex: several properties, a donation with usufruct and a plan that has to fit with documents from another country. After your free 15-minute consultation, we send you a written quote, so you know the number before you commit.
How long does estate planning take?
It depends on what your plan includes. A will is usually ready in a few weeks. Donations and changes to property titles take longer, because they’re signed before a notary and then registered: usually 1 to 3 months. We give you a realistic timeline before we start.
Can I leave my Argentine property to anyone I choose?
Not entirely. Argentina has forced heirship (legítima): if you have children, two-thirds of your estate is reserved for your children and spouse; if you don’t, one-half is reserved for your spouse or parents. You can freely leave the rest. That’s exactly why planning ahead matters: we show you what you can do within those rules to protect the people you care about.
Is a will the same as an estate plan?
No. A will is one tool. An estate plan looks at the whole picture: your family, your assets in Argentina and abroad, how your property is titled and how everything should pass on, so your heirs avoid problems later.
Can my will from the U.S. or another country be used in Argentina?
Often, yes, if it meets the formal requirements of the place where it was signed and it’s apostilled and translated. But Argentine forced heirship rules still apply to your property here, so a foreign will may not work the way you expect. Send it to us, and we’ll tell you whether you need a separate Argentine will.
