{"id":776,"date":"2012-12-23T12:42:53","date_gmt":"2012-12-23T12:42:53","guid":{"rendered":"https:\/\/www.kierjoffe.com\/news\/?p=776"},"modified":"2018-07-19T15:38:15","modified_gmt":"2018-07-19T18:38:15","slug":"argentina-how-transfer-dividends-profits-abroad-dape","status":"publish","type":"post","link":"https:\/\/www.kierjoffe.com\/news\/lawyer-argentina-attorney-buenos-aires-law-firm\/argentina-how-transfer-dividends-profits-abroad-dape\/","title":{"rendered":"Argentina: How to Transfer Dividends and Profits Abroad (DAPE)"},"content":{"rendered":"<h2>Argentina adopts new early declaration for payments \u00a0abroad<\/h2>\n<h2>How to Transfer Dividends and Profits Abroad from Argentina: Declaracion Anticipada de Pagos al Exterior or DAPE.<\/h2>\n<p>This system will enter into force on 1 February 2013 and will also apply to\u00a0transactions previously agreed whenever any amounts are still outstanding\u00a0as of that date.<\/p>\n<p>This new\u00a0<strong>DAPE<\/strong>\u00a0system adds to the already existing early declaration system for services (in Spanish,\u00a0<em><strong>Declaraci\u00f3n Jurada Anticipada de Servicios<\/strong><\/em>\u00a0or\u00a0<em><strong>DJAS<\/strong><\/em>) in force since 1 April 2012, and the early declaration system for imports (in Spanish,\u00a0<em><strong>Declaraci\u00f3n Jurada Anticipada de\u00a0<\/strong><\/em><br \/>\n<em><strong>Importaciones<\/strong><\/em>\u00a0or\u00a0<em><strong>DJAI<\/strong><\/em>) in force since 1 February 2012.<\/p>\n<p>The Argentine Federal Tax Authorities (AFIP) issued General Resolution 3417\/2012 (published in the Official Gazette\u0005\u0006 \u0007\bon 20 December 2012), creating a new \u201c<em>Early Declaration for Payments Abroad<\/em>\u201d (in Spanish <em><strong>Declaracion Anticipada de Pagos al Exterior<\/strong><\/em> or <em><strong>DAPE<\/strong><\/em>).\u00a0As per this resolution, \u00a0Argentine tax residents will be required to file the <em><strong>DAPE\u00a0<\/strong><\/em>through\u00a0authorities\u2019 web site to disclose information related to payments to be made\u00a0abroad in relation with the following concepts: a) debts for the purchase of\u00a0goods not imported into the country and sold to third countries, b) interest, c) dividends and profits, and d) imports through courier or certain simplified mechanism.<\/p>\n<p>The information included in the <em><strong>DAPE<\/strong><\/em>\u00a0fillings will be available for governmental organizations involved in the control of such transactions in\u00a0order to issue their opinions.
